Photography By Roy User Agreement.Please note that by submitting this form you acknowledge and understand that your photographer, like most photographers, does retain the copyright to his creative work (photographs) and this form shall act as a standard model release form. Our goal is to make this page as easy to understand as possible, we do not want our clients to ever feel like they were misinformed, if you have any questions at all please do not hesitate to contact Photography By Roy before digitally signing this form. .
As a user of our photo service, you agree to the following: Image Use, please be advised: Photographs resulting from all photo sessions are the property of Photography By Roy. Clients/subjects may purchase prints of resulting images, but they may not copy those prints and/or use them in any way other than standard decorative display (on a wall, in a frame, or in a standard photo album). The images may not be scanned into a computer, photographed, photocopied, or reproduced in any way. They may not be sent, shared, distributed, published, or posted to the Internet in any way, at any time, under any condition (with the exception of sharing your online gallery/password). By hiring Photography By Roy you acknowledge that we reserve the right to use, publish or release for publication any images from your session. With the understanding that there will be no exploitation, and that any photographs used will conform to standards of good taste. Please note: Unless you are opting for a package that includes the file, no files are included with your session. Clients do have an option to purchase all the files or a single image for an additional charge. Purchasing the files will grant you usage right. You may use your purchased files to make your own prints, greeting cards, holiday cards, birth announcements, photo slide shows, photo books, albums, enlargements, etc. Images remain property of Photography By Roy and may not be commercially reproduced or sold These terms are protected by the United States copyright law and legally enforced by Photography By Roy. If you are hoping to possibly use images from your photography session for any kind of print, graphic, or display, you must first obtain express written permission from Photography By Roy and sign a formal agreement outlining terms and conditions of use. Please make us aware of any interest you may have in using or reproducing images before setting up a session. In this case, additional fees will apply. Payments Session fee. Payment in full (for the session fee plus order minimum if applies) is collected at the end of the photo session using cash or check. Additional products and/or prints are paid for prior to shipment, we currently accept Visa/Mastercard or Paypal, We use SSL encryption, so your order is completely secure. Prepaid – A la carte for home-studio sessions: Please note: Home sessions with a studio setup now have a prepaid minimum (towards prints/files/cd in your cart) due at the end of your session along with your session fee. For newborn sessions that prepaid minimum is simply the CD option, there is no other order minimum requirement. Newsletters Once you’ve purchased any of our services, you are automatically enrolled in our mailing list. We may send you newsletters from time to time to let you know about new services or to announce a promotion/contest/survey. We will not sell your information to third parties. You may choose to opt-out of the newsletter at any time by following the unsubscribe instructions at the bottom of the newsletter. Quality We always use professional gear and use professional quality papers and product for our clients. Although every effort will be made to ensure your satisfaction, individual results may vary. Additional printsSessions usually include some prints (i.e.: 5 5×7’s and 1 8×10) A CD is never a part of any standard package. We collect NYS sales tax on all Print/CD orders. Shipping on print orders is currently flat at $7 per order… Including your free print package order. Turnaround from time of ordering your prints is about 10-15 days (usually faster) Rush Processing & Shipping is available ($5) Your gallery will be available online for the duration of 1 year. This is where “proofing” and ordering takes place. This Agreement contains the entire agreement between you and Photography by Roy regarding the use of the Web Site and our service. If any provision of this Agreement is determined to be invalid, the remainder of this Agreement shall continue in full force.
Your Eligibility (Senior portraits clients) You must be eighteen or over to use our service. Otherwise, a parent or guardian must sign this form (digitally) for you. By using this Web Site, you represent that you have the legal capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement. By agreeing to our terms and conditions, you declare that the information that you disclosed on the site is correct and that you agree to pay for our service at the current advertised rate.
Liability LimitationExcept in jurisdictions where such provisions are restricted, in no event will Photography By Roy be liable to you or any third person for any indirect, consequential, incidental, special or punitive damages, including lost profits arising from your use of the Web Site or the Service, even if Photography By Roy has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Photography By Roy‘s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Photography By Roy for the Service during the term of membership.
